July 18 2005 MOT Walmart horror

Ok so we got done with our CRAZY shopping... After six wic checks and a cart of groceries the kids were ready to GO HOME... Well of course my oldest TRIP DS had to go Potty so him and big brother went in... I had the other two because of course like usual I was alone.. with the kids and two CARTS FULL... Anyway, they and I was standing in the entrace to the door way when they came out.. WELL JEREMIAH WAS gushing blood everywhere... OMG he was not crying he simply held up his finger and said OUCH MOMMY GO TO THE DOCTOR... UGH I rushed everyone to customer service and asked for help... UGH This is walmart I GOT NO HELP... THey had a hard time finding bandaids UGH bandaids remember he is GUSHING BLOOD the top part of his finger pad was HANGING OFF..... THis nice man from behind could tell I needed more hands and help... my other two trips had freed themselves and were going crazy. Well we bandaged him up but by the time we got to the car his gauze pads were soaked.. thank goodness a good friend of mine was around so I could rush him ALONE to the ER.... He has three surgical strips and a gauze cast to his finger... We have to keep it dry for as long as possible... He was to little to have stiches but the doctor said he would of liked to put 3 in... but he is hoping this strips will heal it.... I am just slightly upset with Walmart... they never bothered to call a manager, or anything... I had to inform them twice to call the maintance man because we had blood half way across the front of walmart... My oldest DS said he thinks it was from the paper towel holder.. UGH..... SO scary.... but he is ok... His poor finger is really going to hurt tomorrow.....
Well sorry to VENT... I AM NOT A FAN OF OUR SUPER WALMART.. it just opened in March and it drives ME CRAZY... UGH... I hate to see it the day after thanksgiving UGH... I am assuming our after thanksgiving sale will be a nightmare.......

Well goodnight everyone I have TONS Of laundry to fold but I managed to rent some awesome movies to watch... MY kiddos are sleeping...

Yikes...so sorry! How crappy that Walmart didn't act like they wanted to help. I'm glad your friend was there to help & I'm glad your little one will be alright. Poor thing & poor mommy. As if the chaos of Walmart isn't bad enough & to add that to the mix...UGH is right! You relax & watch those movies!

I agree with everyone else! File a report!!!!! They should be liable to pay for the cost of your DS injuries. One of my DF's husband had an accident at Wal-Mart and the last I heard of it, Wal-Mart was working on a settlemet. Like the other posters said there may be complications with the finger later on. I injuried my finger almost 13 yrs ago and it will never be the same!
Good luck and I hope your little one's finger is OK after all said and done.

You need to go back with your older son and find out where and how the accident occurred. Take your camera with you and photograph the offending area -- if it is still there. My guess is that your telephone call has tipped off an investigation and the problem has been corrected already. This is great for the next guy, but you have absolutely no proof as to what happened.

Still, so long as you are not trying to get rich by this accident, I would suggest that you fill out the claim form and then ask Wal-Mart to pay for the ER visit, the sutures, etc. If they'll do this, you'll be pretty much even; and, if you'll agree to this, they won't need to hire lawyers and play stupid games. Sounds like a win-win to me. Oh, and this isn't legal advice since I am most likely not licensed to practice law in your state. Still, you would need to be able to explain how the accident occur and show the defect that caused it for liability to arise in most states.

Oh, and I'm glad that the people were more helpful this morning.

Amy,

I am glad that your son is OK now, but you will want to call Walmart right away in the morning and ask to file an accident report. I don't want to sound all doom-and-gloom, but you want the accident on record just in case their are any complications w/ the finger healing. Hopefully you will never have to use the accident report, but at least you will have it on file.

i agree with pp and call and file an report in the morning. if it is any thing like our wally world here they will do nothing with an item that causes injuries unless there is a report on it.

once my dd was at fred meyer in the play land and she was playing and somthing fell on her and the attendent didnt even mention anything when we picked her up and then we noticed the bruise on her ear. and when we questioned the place they kind of brushed it off as nothing till I talked to the manager and filled a report and well i never saw that attendent there again. and they gave us a 100 gift card to boot.

I'm sorry about your horrible experience. Your poor little boy. I also agree about the accident report. Make sure you fill everything out completely. I saw a segment on 60 minutes about Walmart's big bullying legal department. They are consistantly known for not doing the right thing by the customers, even when it is clear they have been neglegent.

Amy -
I work for another retailer and cannot imagine any company not filling out an accident report - we take pictures, sometimes escort folks to the doctor, call an ambulance - whatever. Guess we shouldn't be surprised since it is Walmart huh? But..only trained individuals in our store are allowed to deal with blood-borne pathogins of which blood is one. Perhaps the person they should have called is loss prevention since in many stores, they are the trained individuals and should have known you needed something absorbant enough to hold on as pressure is applied. How frustrating for you.
I would most definately follow through on complaints - as high up as you can go.

This was my thought. I'd write a letter to the manager and ask for an explanation of their emergency procedures.

That's horrible! What a bad design if it was the paper towel thingie. I remember my daughter choking at Home Depot THANK GOODNESS I was there after reading your story. I just thought all places would be so on the ball, they even called 911 for me. Thank goodness we didn't need it but still it was nice to not have to do all the thinking (like cleaning up the floor). I hope his little finger heals.

If it were me I would think about reporting this. Now that I think about it my dd fell at WM and they wanted to fill out a report b/c she was crying so hard no blood and b/c they were tearing up the floors. hmmm

All I can say is I am very sorry this happened to you and I do sympathize with having to go it alone. Walmart sucks. I worked for them for a short time and their business practices are really terrible. For a long time I wouldn't even go near a Walmart. Now they are the only place that carries all the formula I need.
